Stillee Terms of Service

1. Introduction

Welcome to Stillee. These Terms of Service (these “Terms”) govern your use of the Stillee mobile app, our website at stillee.com (the “Site”), and the content, products, and services we provide (together, the “Service”). They are an agreement between you and Competente Nuvem - Lda, a company based in Portugal (“Stillee”, “we”, “us”, or “our”).

Please read these Terms carefully. By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. You may also be asked to tap “I agree” before you can complete a purchase or use certain features. If you do not agree to these Terms, please do not use the Service.

2. What Stillee is — and what it isn't

Stillee offers guided meditations, breathing exercises, and reflective tools to help you find calm and support your everyday wellbeing — including in difficult, anxious, or panicked moments. Our tools draw on established mindfulness and breathing practices that many people find genuinely helpful. At the same time, we want to be clear about the limits of what an app can do.

  • Not medical care. Stillee is not a medical device and does not provide medical, psychological, or clinical advice, diagnosis, or treatment. It is a companion to professional care, not a substitute for it. Results vary from person to person, and we don't promise any specific outcome or therapeutic benefit.
  • Talk to a professional. Always seek the advice of a qualified health professional about a medical or mental-health condition, and never disregard or delay it because of something in the Service. If you have an existing mental-health condition, please speak with your health-care provider before relying on Stillee.
  • Not an emergency or crisis service. Stillee isn't designed for medical or mental-health emergencies. If you are in crisis, thinking about harming yourself, or facing a medical emergency, the fastest way to get real help is to contact your local emergency number or a crisis line right now — in the US, call or text 988; elsewhere, findahelpline.com lists local services. Please reach out to them first; Stillee will be here when you're ready.

3. Who can use Stillee

You must be at least 18 years old to use the Service. By using Stillee, you confirm that you are 18 or older and legally able to enter into these Terms.

4. Your account

You'll need an account to use most of Stillee. You agree to provide accurate information, keep your login credentials secure, restrict access to your device, and tell us promptly if you suspect unauthorized use of your account. You are responsible for activity that happens under your account. You can ask us to delete your account and its data at any time (see the Privacy Policy), and you may stop using the Service whenever you like.

5. Subscriptions, billing, and cancellation

Some features require a paid subscription. You can also use parts of Stillee with a free account.

5.1 Billing through the app stores. Subscriptions are sold and processed by Apple (App Store) and Google (Google Play). Payment is charged to your store account when you confirm the purchase. We do not receive or store your card number or full payment details.

5.2 Plans and auto-renewal. We offer monthly and annual subscriptions. Paid subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends. The exact price and billing period are shown to you at the time of purchase.

5.3 Free trials. If we offer a free trial, its length is shown when you sign up. Unless you cancel before it ends, the trial converts automatically to a paid subscription and your store account is charged. We may change or withdraw trial offers at any time.

5.4 Managing and cancelling. You manage renewals and cancellations in your Apple or Google account settings, not inside Stillee. Cancelling stops future renewals; it does not retroactively refund the current period.

5.5 Refunds. Purchases are processed by Apple or Google, so refunds are handled by them under their policies, and refund requests should be made to the relevant store. Where the law gives you a statutory right to a refund or withdrawal, that right still applies.

5.6 Price changes. We may change subscription prices. Changes apply to future billing periods, and we will give you notice in advance as required by the app stores and applicable law. If you don't agree to a new price, you can cancel before it takes effect.

6. Your license to use Stillee

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to stream and use the Service for your own, non-commercial use. You agree not to, and not to help anyone else: copy, modify, distribute, sell, rent, lease, or publicly display any part of the Service; reverse-engineer, decompile, or try to extract source code (except to the extent the law expressly allows); circumvent any security or content-protection technology; share your account or resell access; scrape or bulk-download content; or use the Service to build a competing product. All rights not expressly granted to you are reserved by us and our licensors.

7. Our content

The Service — including its meditations, audio, text, designs, trademarks, and software — is owned by Stillee or our licensors and is protected by intellectual-property laws. We give you a license to use it (Section 6); we do not transfer ownership, and you gain no rights in it beyond that license. Please don't reproduce, distribute, or publicly share our content outside the Service without our written permission.

8. Your content and feedback

8.1 Your content. Things you create in Stillee — your journal entries, reflections, and check-ins — belong to you. We don't claim ownership of them. You grant us only the limited license needed to store and process your content so we can provide the Service to you (for example, to save your journal and show your history), as described in our Privacy Policy. Your journal content is private to your account; Stillee has no public community or feed, so your entries are not posted or shared with other users. You are responsible for what you put into the Service, and you agree not to input anything unlawful.

8.2 Feedback. If you send us ideas, suggestions, or feedback about the Service, you allow us to use them without restriction or obligation to you. Feedback is given voluntarily and is not confidential.

9. Acceptable use

Please use Stillee lawfully and respectfully. You agree not to: use the Service to break the law or infringe anyone's rights; upload or transmit viruses or harmful code; interfere with or disrupt the Service or its servers; attempt to gain unauthorized access to the Service, other accounts, or our systems; or probe or test the security of the Service except with standard, commercially available anti-malware tools on your own device. We may suspend or limit access to protect the Service or other users.

10. Availability and no guaranteed outcome

We aim to provide a reliable Service, but we don't promise it will be uninterrupted or error-free, and we may occasionally restrict access for maintenance, updates, or repairs. We also make no promise that using Stillee will produce any particular result or change in how you feel — wellbeing is personal, and how much the Service helps will differ from person to person. If you find a fault, please tell us at support@stillee.com and we'll look into it.

11. Third-party services

The Service relies on third parties (such as the app stores and the service providers listed in our Privacy Policy) and may link to other sites or services we don't control. Your use of those is governed by their own terms and policies, and we're not responsible for them.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” and we disclaim all warranties of any kind, whether express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free. Nothing in these Terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded — and nothing affects your mandatory rights as a consumer under the law of the country where you live, including EU and Portuguese consumer-protection law, which cannot be waived.

13. Limitation of liability

To the fullest extent permitted by law, Stillee and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service. Where our liability cannot be excluded, our total liability to you is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or the minimum amount the law allows. This Section does not affect the mandatory consumer rights referenced in Section 12.

14. Indemnity

You agree to be responsible for, and to reimburse us for, reasonable losses we incur arising from your unlawful use of the Service, your breach of these Terms, or your violation of someone else's rights. This Section applies only to the extent permitted by law and does not apply to matters caused by us.

15. Termination

You can stop using Stillee at any time and ask us to delete your account. We may suspend or end your access if you materially breach these Terms, if required by law, or to protect the Service or other users — where practical and lawful, we'll give you notice. Sections that by their nature should survive — including content ownership, disclaimers, limitation of liability, and governing law — will survive termination.

16. Changes to the Service and these Terms

We may update the Service and these Terms from time to time. If we make material changes to the Terms, we will revise the date above and, where appropriate, give you notice in the app or by email. Changes take effect when posted (or on the date we state), and continuing to use the Service after that means you accept the updated Terms. If you don't agree, please stop using the Service.

17. Governing law and disputes

These Terms are governed by the laws of Portugal. If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live, and nothing in these Terms affects those rights. As an EU consumer, you may be able to bring proceedings in the courts of your country of residence; otherwise, the courts of Portugal will have jurisdiction. We'd always prefer to resolve things directly first — please contact us at support@stillee.com.

18. Apple App Store

If you download Stillee from the Apple App Store, the following also applies and prevails over anything inconsistent above:

  • These Terms are between you and Stillee only, not Apple, and Apple is not responsible for the app or its content.
  • Your license to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the app, including product-liability, legal or regulatory, or third-party intellectual-property claims.
  • You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. Government prohibited- or restricted-parties list.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. General

  • Assignment. You may not transfer your rights under these Terms. We may transfer ours to another company as part of a reorganization or sale, provided it doesn't reduce your rights.
  • Entire agreement. These Terms and the documents they reference (including the Privacy Policy) are the whole agreement between us about the Service.
  • Severability. If any provision is found unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a right straight away, we don't lose it.
  • Force majeure. We're not liable for failures or delays caused by events beyond our reasonable control.
  • Electronic communications. You agree we may communicate with you electronically (in the app or by email), and that this meets any legal requirement for writing.
  • Copyright concerns. If you believe content in the Service infringes your copyright, email support@stillee.com with details and we'll review it.
